Data View Texas ("Data View Texas," "we," "us," or "our"), a sole proprietorship, operated by William Griffith, Sole Member.

 

SUMMARY TERMS AND POLICIES

These Terms of Service, together with our Privacy Policy, Terms of Use, any additional policies, future modifications, and any applicable Order Form (collectively, the “Agreement”), govern your access to, evaluation of, or acquisition and use of our Services. Please read carefully.

 

This Agreement is between us (“Data View Texas”, “We”, or “Our”) and you (“Customer”, “Client”, “Partner”, or “Your”). By accepting this Agreement—whether by accessing or browsing Data View Texas or partner websites; by clicking a box indicating your acceptance; by executing an Order Form that references this Agreement; or, for free services, by using such Services—you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

 

If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “You” or “Your” shall refer to such entity. If you do not have such authority, or if at any time you do not agree with this Agreement, you must not accept this Agreement.

 

TERMS & CONDITIONS OF SALE – BUYERS PURCHASE AND PAYMENT AGREEMENT

The undersigned purchaser and approver hereby order and agrees to the purchase and payment of digital, deployment, strategy, planning, marketing, advertising, and/or other services provided by Data View Texas and/or its staff, contractors, or vendors acting on behalf of Data View Texas, pursuant to the terms set forth in the Data View Texas Terms and Agreements.

 

Purchaser acknowledges and agrees to payment for the services requested via their signature or separate approval sent by email or other electronic acknowledgment. This form also serves as their purchase agreement and acceptance for additional services requested verbally and approved or acknowledged electronically.

 

OUR COMMUNICATIONS POLICY

We do not share or sell your information. Our policy is to be tactful, discreet, and respectful at all times regarding the business information of all our clients (yours and others), whether that information is public, unpublished, confidential, and/or proprietary.

 

COMMUNICATIONS CONSENT — PHONE CALLS AND TEXT MESSAGES

By providing your phone number to Data View Texas, whether verbally during a phone conversation or by submitting a form on our website, you consent to receive phone calls and text messages from Data View Texas related to our products, strategy or digital services, including scheduling, follow-ups, and service-related updates.

●         Message frequency varies.

●         Message and data rates may apply, depending on your mobile carrier plan.

●         You may opt out at any time by:

 Replying STOP to any text message,

 Or by informing us during a phone call that you no longer wish to be contacted.

 Reply HELP to a text message for assistance.

●         Consent to receive text messages is not a condition of purchasing any services from us.

HOW WE OBTAIN CONSENT

We collect consent to contact prospects and clients by phone and text through the following methods:

●         Verbal consent during outbound calls - during an initial or follow-up business call, we confirm that you agree to receive further calls and/or text messages from us regarding the services discussed.

●         Web form consent - when you submit an inquiry, contact, or quote request form on dataviewtx.com, you affirmatively check a consent checkbox before submitting.

We do not send promotional or marketing text messages to any number without consent obtained through one of the above methods.

 

CONFIDENTIAL AND PROPRIETARY INFORMATION

All information about or relating to the business of our clients and your clients—including all Intellectual Property Rights, processes, lists, customer information, contact names, methods, metrics, internal communications, operations, or any other information which is not in the public domain—is considered confidential and/or proprietary. We consider all one-to-one or internal group communications proprietary, if not fully confidential.

 

DIRECT COMPETITORS AND FIRST RIGHTS TO EXISTING CLIENTS

You may not access the Services if you are acting as a direct competitor or soliciting the same client (or potential client) for services offered by others with the same products, except with our prior written consent. In addition, you may not access our services for the purposes of monitoring availability, performance, duplicating functionality, or for any other benchmarking or competitive purposes intended to solicit business away from an existing provider or from Data View Texas.
